Welcome to MyBackrooms.com, a metaverse platform operated by Ziweq ("we," "our," or "us"). By accessing or using the MyBackrooms.com website (the "Site") and its services (the "Services"), you ("User" or "you") agree to be bound by the following terms and conditions ("Terms of Use"). If you do not agree with these Terms of Use, you may not use the Site or Services.

1. Acceptance of Terms

By creating an account, by checking the acceptance box at registration, or by accessing or using any part of the Site or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, as well as our Privacy Policy.

2. Eligibility and Accounts

You must be at least 16 years old (or the minimum age of digital consent in your country) to create an account, and at least 18 years old — or have the consent of a parent or legal guardian who agrees to these Terms on your behalf — to make any purchase. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date.

3. User Content

MyBackrooms.com allows Users to upload, post, or otherwise share content ("User Content"). You retain ownership of your User Content but grant Ziweq a worldwide, non-exclusive, royalty-free, transferable license to use, host, store, reproduce, modify, create derivative works, and display your User Content to operate, improve, and promote the Services.

You are solely responsible for the User Content you upload, post, or share on MyBackrooms.com. You represent and warrant that you own all necessary rights to your User Content and that it does not violate any applicable laws, regulations, or third-party rights.

4. Prohibited Conduct

Users may not engage in the following activities on MyBackrooms.com:

Uploading or sharing content that is unlawful, harmful, defamatory, obscene, or infringing on intellectual property rights.
Using the Site or Services for fraudulent, malicious, or deceptive purposes.
Attempting to access or compromise the security of the Site or Services.
Harassing, threatening, or impersonating other Users.
Buying, selling, transferring, or attempting to exchange Diamonds or accounts for real money or other value outside the Services.

Reporting and moderation. Any User Content can be reported — from its public page ("Report this content") or from inside the game ("Report this map") — without an account. A human reviews every report, and we may remove, unpublish, or restrict content that violates these Terms at our sole discretion, without notice to its creator. Uploaded content is additionally screened automatically before publication.

5. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is the property of Ziweq or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content from the Site without prior written permission from the creators of the platform.

6. Virtual Currency ("Diamonds")

The Services include a virtual currency called "Diamonds" (💎) that can be used to access certain premium features (for example, AI generation, additional levels, and custom textures, images, or 3D models). Diamonds are a limited, personal, non-transferable, revocable licence to use a feature of the Services. Diamonds:

are not your property, real-world money, legal tender, a bank deposit, or electronic money;
have no monetary value, cannot be sold, traded, or transferred between accounts, and cannot be exchanged, redeemed, or "cashed out" for real money, goods, or anything of value outside the Services, except where required by applicable law;
are licensed to you, not sold, and remain our property; and
are consumed when you spend them on a feature — once spent, they are used and are not restored except as expressly stated in these Terms or required by law.

To the extent permitted by law, we may create, manage, price, modify, or discontinue Diamonds or any feature they unlock, and may change the number of Diamonds a feature costs, at any time. Diamonds granted for free (for example, a welcome grant or a gift) are not purchases and may be modified or removed at any time. Any unused Diamonds are forfeited if your account is terminated or suspended for a breach of these Terms.

7. Purchases, Payments and Billing

You may purchase Diamonds:

On the web, through our third-party payment processor (Stripe). By purchasing, you authorise us and our processor to charge your chosen payment method for the amount shown, including any applicable taxes.
In our mobile application, through the Apple App Store or Google Play in-app-purchase systems. Those purchases are processed by, and are also subject to the terms and policies of, Apple or Google respectively.

Prices are shown at the point of purchase and include applicable taxes (such as VAT) where required. We may change prices and the contents of Diamond packs at any time; changes apply to future purchases only. We do not store your full payment-card details — these are handled by the applicable payment provider.

8. Refunds and Right of Withdrawal

Diamonds are digital content delivered to your account immediately upon completion of your purchase. To the maximum extent permitted by applicable law, all purchases are final and non-refundable once the Diamonds have been credited to your account.

Consumers in the European Union / EEA. You would normally have a 14-day right to withdraw from a purchase of digital content. However, because Diamonds are supplied immediately, by completing a purchase you expressly request that we begin performance immediately and you acknowledge that you thereby lose your right of withdrawal once the Diamonds have been delivered, in accordance with Article L.221-28 of the French Consumer Code (transposing Directive 2011/83/EU). This does not affect your mandatory statutory rights where digital content is defective or not as described.

In-app purchases. Refunds for purchases made through the Apple App Store or Google Play are handled by Apple or Google under their own policies, which we do not control. Please contact the relevant store for any such request.

Nothing in this section limits your non-waivable rights as a consumer under applicable law.

9. Assumption of Risk and User Responsibility

MyBackrooms.com is a user-driven platform. We do not create, endorse, verify, or control User Content or the conduct of Users. You use the Site and Services, and interact with other Users and their content, entirely at your own risk, and you are solely responsible for how you use the Services and for any consequences of that use. To the maximum extent permitted by law, we are not responsible or liable for:

User Content, or the conduct, worlds, or communications of any User or third party;
any interaction, dispute, or transaction between Users;
any third-party sites, services, content, or links accessible from the Services;
any loss of, or inability to access, your User Content, data, worlds, or Diamonds;
any interruption, downtime, error, bug, or loss of data; or
any decision you make or action you take based on the Services.

10. Disclaimers of Warranty

The Site and Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the Site or Services will be uninterrupted, timely, secure, or error-free, or that any content is accurate or reliable.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Ziweq, its affiliates, or its officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or Diamonds, arising out of or related to your use of (or inability to use) the Site or Services. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the total amounts you paid to us in the twelve (12) months before the event giving rise to the liability, or (b) fifty euros (€50).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for a consumer's mandatory statutory rights.

12. Indemnification

You agree to indemnify and hold harmless Ziweq and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Services, or your breach of these Terms or of any law or third-party right, except to the extent such claims arise from our own wrongdoing.

13. Termination

We reserve the right to suspend or terminate your access to the Site or Services at our sole discretion, without prior notice, if we believe you have violated these Terms of Use or engaged in prohibited conduct. On termination for breach, any unused Diamonds may be forfeited without a refund, to the extent permitted by law.

14. Governing Law and Consumer Rights

These Terms of Use are governed by and construed in accordance with French law, without regard to its conflict-of-law principles. If you are a consumer, you also benefit from any mandatory protections of the law of your country of residence, and nothing in these Terms deprives you of those rights. Consumers may also use the European Commission's Online Dispute Resolution platform to resolve disputes.

15. Changes to Terms

We may update these Terms of Use from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Site or Services following any changes constitutes your acceptance of the revised Terms of Use.
